It is important to remember that Indigenous youth charged with a crime have the same rights as all other young people. They also have extra rights and options, due to the ongoing effects of colonialism, racism, and residential schools in Canada.

Courts must always consider the unique circumstances of Indigenous people and their communities. When deciding on a sentence, judges must look at alternatives to jail whenever possible.

If jail is chosen, the sentence should be based on the youth’s culture, experiences, and challenges. It must also support the youth's healing process.
