Family Law in Nunavut
Family law deals with many issues that affect families, such as parenting, child protection, financial support, and separation. In Nunavut, all family law matters are handled by the Nunavut Court of Justice. Justices of the Peace (JPs) may also hear some cases, such as those involving custody, support, and temporary child protection orders.
Family law helps people settle disputes about:
- Parenting and custody
- Child and spousal support
- Separation and divorce
- Child welfare and protection
- Who can stay in the family home
- Restraining orders for safety
If you qualify, the Nunavut Legal Services Board can provide legal aid to help with family law matters.
When married or common-law couples separate or divorce, one spouse may have to provide financial support to the other and their children if they have any.
This section explains ways that family law disputes can be resolved outside of the courtroom. The Nunavut Court of Justice supports these processes to help families find solutions respectfully and cooperatively.
Family cases can involve different stages and types of court appearances. Sometimes you must go to court in person. Other times, you may be able to attend by phone or video conference.
